MRS ANNE MARTIN

Misconduct in Public Office

That Anne Martin, an Employment Tribunal Judge on the Southeast Circuit, on dates between 14 January 2008 and 31 May 2008, wilfully neglected to perform her duty and wilfully misconducted herself to such a degree as to amount to an abuse of the public’s trust in the office holder without reasonable excuse or justification, in that she held two unlawful Employment Tribunal hearings on 14 January 2008 and 25 February 2008 and that she authored a Judgment which was not meritorious and based on the facts; that she failed to report crimes of child grooming, racism and harassment which had been brought to her attention; and that she failed to conduct a bona fide Employment Tribunal Hearing.

Perverting the Course of Justice

Anne Martin, an Employment Tribunal Judge, on days between 13 January 2008 and 31 May 2008, with intent to pervert the course of public justice, did a series of acts which had a tendency to pervert the course of public justice in that she:
                    
i.        authored a Judgment which she knew to be false
ii.      failed to conduct a bona fide Tribunal Hearing in accordance with the law
iii.    failed to report to the appropriate authorities allegations of child abuse, bullying and racism
iv.    abused her position of trust


Harassment

Anne Martin, an Employment Tribunal Judge on the Southeast Circuit, on days between 13 January 2008 and 31 May 2008, did pursue a course of conduct amounting to the harassment of Brian Pead and did cause him and his daughter and grand-children alarm and distress contrary to the Protection from Harassment Act 1997.


Fraud by failing to disclose information

Anne Martin, an Employment Tribunal Judge on the Southeast Circuit, on days between 13 January 2008 and 31 May 2008, did commit fraud by deliberately failing to disclose documents to Brian Pead, to the police, to an Employment Tribunal, and to the Courts, and that she failed to report child grooming, racism and bullying, contrary to the Fraud Act 2006.


Fraud by abuse of position

Anne Martin, an Employment Tribunal Judge on the Southeast Circuit, on days between 13 January 2008 and 31 May 2008, did abuse her position as an Officer of the Court in that she (and others) perpetrated a series of crimes and human rights abuses against Brian Pead and pursued a course of conduct amounting to the harassment of Brian Pead which she knew, or ought to have known, would cause him and his family alarm and distress, contrary to the Fraud Act 2006, the Protection from Harassment Act 1997 and the Human Rights Act 1998.

Fraud by false representation

Anne Martin, an Employment Tribunal Judge on the Southeast Circuit, on days between 13 January 2008 and 31 May 2008 did make false representations and provide false documents to other Court Officers and employees, and to an Employment Tribunal in relation to Brian Pead, contrary to the Fraud Act 2006.


Misuse of Public Funds


Anne Martin, an Employment Tribunal Judge on the Southeast Circuit, on days between 14 January 2008 and 31 May 2008, did misuse public funds in perpetrating crimes against Brian Pead and in allowing crimes and human rights abuses to be perpetrated against Brian Pead; and that she authored a false Judgment not based on the facts presented to her; and that she misled the Court and abused the court process.
